Kountr is operated by Kountr Limited, company number 02994226, whose registered office is 6 Ridgeway, Epsom, Surrey, KT19 8LB. By accessing or using Kountr (kountr.co.uk), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the service. You must be at least 18 years old and capable of entering into a binding contract to use Kountr.
Kountr provides bookkeeping and Making Tax Digital (MTD) for Income Tax tools for UK sole traders and UK non-FHL property businesses. Features may include income and expense tracking, invoicing, receipt capture, tax estimates, quarterly updates, business year-end information and, where the supported journey covers the whole of your relevant tax affairs, preparation of a final declaration to HM Revenue & Customs (HMRC).
Kountr does not currently support every income source or tax circumstance. Foreign property, furnished holiday lettings, partnerships, trusts, capital gains and other specialist or unsupported income, reliefs and adjustments may need to be dealt with outside Kountr or with professional assistance. The service will identify some unsupported items, but you must ensure that all of your taxable income and relevant circumstances are correctly dealt with.
Kountr's HMRC integration is currently operating through supported test environments while its production-access application is completed. You must not rely on Kountr as HMRC-listed compatible software until HMRC production access and listing are confirmed. We will update these Terms and the service description if and when production approval is granted. Kountr is not affiliated with or endorsed by HMRC.
Kountr is a software tool. Nothing in the service — including tax estimates, category suggestions, AI-assisted categorisation, extracted receipt information, generated reports, readiness checks or guidance text — constitutes tax, legal, accounting or financial advice. AI-assisted outputs are suggestions or drafts that may be incomplete or incorrect. You must review them before relying on them or including them in your records or submissions. Tax estimates are indicative and may differ from HMRC's calculation. If you are unsure about your tax affairs, consult a qualified accountant or tax adviser.
You remain legally responsible for the accuracy and completeness of information submitted to HMRC through Kountr and for meeting your filing and payment deadlines. Before authorising a submission, you must review the figures, source records, business details and any information obtained from HMRC. HMRC-held or pre-filled information may be incomplete, delayed or incorrect and does not remove your duty to check your tax affairs.
Before making a final declaration, you must ensure that all supported businesses have been updated, review relevant whole-person information (which may include employment, income, tax deducted, National Insurance, status, obligations and calculation data held by HMRC), and deal appropriately with any unsupported income or circumstances. You must only authorise a final declaration through Kountr where the supported journey gives you a complete and accurate view of the information that must be declared.
Kountr does not audit or independently verify your underlying records. By confirming a submission, you make the declaration shown to you in the service and confirm that the information is correct and complete to the standard required by HMRC. Penalties, interest or other consequences arising from inaccurate, late or missing submissions remain your responsibility, except to the extent caused by Kountr's breach of these Terms or failure to exercise reasonable care and skill.
To use connected HMRC features, you must authorise Kountr through HMRC's own sign-in and consent process (OAuth). Subject to the permissions you grant, Kountr may retrieve HMRC-held information, synchronise businesses, obligations and status, and send submissions that you expressly confirm. Kountr stores the resulting access and refresh tokens encrypted at rest. You may revoke Kountr's authority through the access-management options HMRC makes available. Revocation may not delete records that Kountr must retain for legal, security or audit purposes.
HMRC requires software to transmit specified technical information about the user, device and connection with applicable MTD API calls for fraud prevention. Using Kountr's HMRC features therefore involves this collection and transmission, as described in Section 4 of our Privacy Policy.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when creating your account and keep it up to date.
You agree not to: use the service for any unlawful purpose, including submitting information you know to be false to HMRC; attempt to access another user's data; probe, scan or test the vulnerability of the service; reverse engineer the service; or resell access to the service without our written agreement.
Kountr offers monthly and annual subscription plans. Prices, applicable taxes, billing intervals, trial terms and plan features are shown before purchase. Payments are processed by Stripe. By starting a paid subscription, you authorise Stripe to charge your selected payment method at the start of each billing period until the subscription is cancelled.
Subscriptions renew automatically for the same billing interval unless cancelled before the renewal date. You can manage or cancel your subscription through the Stripe billing portal linked from Kountr. Cancellation normally takes effect at the end of the current paid period, and access continues until then unless we tell you otherwise. Fees already paid are not normally refundable for a partly used period, but we will provide any refund or cancellation right required by law and may provide additional refunds at our discretion.
If you are acting as a consumer, you may have statutory rights concerning digital services, including cancellation or remedies where the service is not supplied with reasonable care and skill. Nothing in these Terms affects those rights. We may change subscription prices by giving at least 30 days' notice, with the change taking effect no earlier than your next renewal; you may cancel before it takes effect.
You retain ownership of the records you enter or upload. Subject to available service features, you can export your data and may request or initiate account deletion. We delete or anonymise personal data in accordance with our Privacy Policy, except where retention is required or permitted for legal, tax, security, dispute or audit purposes. You are responsible for retaining the records HMRC requires and should export anything you need before deleting your account.
We aim to keep Kountr available and functioning, but the service is provided "as is" and we do not guarantee uninterrupted availability. Submissions also depend on HMRC's systems, which are outside our control. We may modify, add or remove features and will give reasonable notice of changes that materially reduce the service's core functionality.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory rights as a consumer, or any other liability that cannot lawfully be excluded or limited.
If you use Kountr for business purposes, then, to the fullest extent permitted by law, Kountr is not liable for loss of profit, revenue, business, anticipated savings, goodwill or data, or for indirect or consequential loss. Subject to the paragraph above, our total aggregate liability arising in any 12-month period is limited to the greater of £100 and the fees you paid to Kountr in that period.
If you use Kountr as a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill, but not for loss that is not foreseeable. We do not exclude or restrict any remedy or liability where doing so would be unlawful. In all cases, we are not responsible for losses caused by inaccurate information you provide, your failure to review a submission, an unsupported tax circumstance, or HMRC or other systems outside our reasonable control, except to the extent that Kountr caused or contributed to the loss.
We may suspend or terminate your account if you materially breach these Terms, including by misusing the HMRC connection, or where reasonably necessary to protect users, Kountr or public systems. You may initiate account deletion through the available account controls or contact us. Export records you need before deletion or termination. Data is then handled in accordance with our Privacy Policy and any legal retention obligations.
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect, unless an earlier change is reasonably required by law, regulation, security needs or HMRC requirements. Continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may stop using the service and cancel your subscription before the change takes effect.
These Terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from mandatory protections of the country in which you live and may bring proceedings in any court available to you under applicable law.
